Can I Break My Lease for Noise, Smells, or Pest Issues?
In North Carolina, you can legally break a lease for severe noise, smells, or pest issues, but you cannot do so immediately. The legal basis for this right is the implied warranty of habitability, which requires landlords to provide a safe and livable home. If a problem is so severe that it makes the unit uninhabitable, it can be considered a constructive eviction, which legally releases you from your lease. However, to pursue this, you must first document the problem and give your landlord written notice and a reasonable amount of time to remedy the situation before vacating the property. Breaking a lease without following this process could leave you liable for the remaining rent.
